Description

The Americans with Disabilities Act is complicated and confusing. The federal Family and Medical Leave Act is complicated and confusing. Workers' Compensation insurance is complicated and confusing. That is what all three have as a common thread: complication and confusion.

Do you know what else they have in common? Most companies must comply with all three laws at the same time! Yes, smaller companies may be exempt from federal FMLA requirements however the ADA and Workers' Compensation laws almost always come into play as well as the obligations of the many states who have their own family and/or medical leave laws. PS: Remote workers in other states just add to this complication and confusion!

Learning Objectives:-

  • We will review an overview of each federal law: The ADA, FMLA, Worker's Compensation
  • We will review sample scenarios that may trigger each law and review documentation requirements.
  • We will review company benefits such as PTO, sick time, health and disability insurance, and resources to help you learn more.

Who Will Benefit:-

When employees are injured or disabled or become ill on the job, they may be entitled to medical and/or disability-related leave under two federal laws: the Americans with Disabilities Act and the Family and Medical Leave Act. State workers' Compensation laws also have leave provisions that may apply. Depending on the situation, one or more of these laws can apply to the same employee. Attend to be better prepared when Workers’ Comp, ADA, and FMLA collide.
